We offer this website, including all information, tools and services on it, to you on the condition that you accept these Terms of Service and the policies they refer to.

By visiting our site or buying from us, you agree to these Terms. They apply to everyone who uses the site, including browsers, customers and anyone who contributes content. If you do not agree to all of these Terms, please do not use the site.

New features or tools added to the store are also subject to these Terms. You can review the current version on this page at any time. We may update these Terms by posting changes here, and continuing to use the site after a change means you accept it.

Our store is hosted on Shopify, which provides the e-commerce platform we use to sell to you.

1. Using our store

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for any minor dependents in your care to use this site. You may not use our products or this site for any illegal or unauthorized purpose, or violate any law in your jurisdiction, including copyright law. You must not transmit any viruses or code of a destructive nature. A breach of these Terms may result in the immediate end of your access to our services.

2. General conditions

We reserve the right to refuse service to anyone, for any reason, at any time. Your content (not including card information) may be transferred unencrypted across networks and adapted to the technical requirements of connecting networks or devices. Card information is always encrypted in transit.

You agree not to reproduce, copy, sell, resell or exploit any part of the site, its content or our services without our written permission. Headings in these Terms are for convenience only.

3. Accuracy of information

We work to keep the information on this site accurate and current, but it is provided for general information and may not always be complete. Any reliance on it is at your own risk. We may change the content of this site at any time, but we have no obligation to update it.

4. Made-to-order products

Our furniture is made after you order it, to the size, design and finish you select. By placing an order, you agree to pay the price shown at checkout and to give us accurate information so we can make and deliver your piece. If you request a custom change, we will confirm what is possible, any extra cost and any extra time before we begin.

Solid wood is a natural material. Grain, knots, texture and tone vary from board to board, and your piece will not be identical to the photos. These variations are part of the material and are not defects. Changes, cancellations, refunds and replacements follow our Refund and Replacement Policy. Delivery follows our Shipping Information.

5. Changes to products and prices

Prices are subject to change without notice. We may modify or discontinue any product or service at any time. We are not liable to you or to any third party for any change in price, or for any modification, suspension or discontinuation of a product or service.

6. Products

We have made every effort to show the colors and details of our products as accurately as possible, but we cannot guarantee that your screen will display any color accurately. We may limit sales of any product to any person, region or jurisdiction, and limit quantities, on a case-by-case basis. Product descriptions and prices may change at any time without notice. Any offer made on this site is void where prohibited.

7. Billing and account information

We may refuse or cancel any order. We may limit or cancel quantities purchased per person, per household or per order, including orders placed with the same account, card, or billing or shipping address. If we change or cancel an order, we will try to contact you using the email, address or phone number you gave us. We may limit or refuse orders that appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information, and to update it promptly, so that we can complete your order and contact you.

8. Optional tools

We may give you access to third-party tools that we do not monitor or control. They are provided "as is" and "as available", without warranties or endorsement of any kind, and we have no liability arising from your use of them. Your use of them is at your own risk and subject to the terms of their providers.

We are not responsible for the content or accuracy of third-party sites or materials and are not liable for any harm related to purchases or other transactions made with them. Information on our site may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, shipping charges, delivery times or availability. We may correct them, and change or cancel orders if information is inaccurate, at any time without prior notice, including after you have placed your order. If we cancel an order for this reason, we will refund any payment you made for it.

13. Prohibited uses

You may not use the site or its content: (a) for any unlawful purpose; (b) to solicit others to take part in unlawful acts; (c) to violate any international, federal, state or local law or regulation; (d) to infringe our intellectual property or that of others; (e) to harass, abuse, defame or discriminate against anyone; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or get around the security features of the site. To the maximum extent permitted by law, CARVERHAUS and our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors are not liable for any indirect, incidental, punitive, special or consequential damages, including lost profits, lost revenue, lost savings, loss of data or replacement costs, arising from your use of the site or any product, whether based in contract, tort (including negligence), strict liability or otherwise. Some states do not allow the exclusion or limitation of liability for consequential or incidental damages; in those states, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend and hold harmless CARVERHAUS and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable attorneys' fees, made by a third party arising from your breach of these Terms or the documents they incorporate, or your violation of any law or the rights of a third party.

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the remaining provisions.

17. Termination

Obligations and liabilities incurred before termination survive it. These Terms remain in effect until ended by you or us. You may end them at any time by telling us you no longer wish to use our services, or by ceasing to use our site. If we believe you have failed to comply with these Terms, we may end them at any time without notice, you will remain liable for all amounts due up to that date, and we may deny you access to our services.

These Terms, together with the policies and operating rules we post on this site, are the entire agreement between you and us and govern your use of the site, replacing any prior agreements, communications and proposals, oral or written.
